PRIVACY NOTICE – KOREA PRIVACY SCHEDULE This Korea Privacy Schedule supplements our General Privacy Notice and applies where the Personal Information Protection Act of Korea applies to our processing of personal information. PERSONAL DATA WE COLLECT We may capture photographs, video or other recordings of the Event, which may include images of guests, hosts, clients, talent, vendors and other attendees. We use this material for Event documentation, reporting, publicity, social media, internal records and marketing, where permitted by applicable law. Where photography, filming or recording takes place at an Event, we or our clients will normally provide signage or other notices. For crowd, atmosphere or incidental imagery, we generally rely on legitimate interests, unless consent is required by applicable law. Where an individual is featured prominently, interviewed, contracted as talent or otherwise engaged to participate in content, we may use consent, release forms, contractual terms or another appropriate lawful basis. If you do not wish to be photographed or recorded, please speak to an Event staff member or contact us in advance, and we will do our best to accommodate your request where reasonably practicable. We do not use Event images or recordings for biometric identification or facial recognition unless we notify you separately and do so in accordance with applicable law. We may be provided with guest, attendee or vendor list details, which are ordinarily limited to basic contact and attendance information, such as name, organisation, role, email address, telephone number, attendance status and any information required for Event access, security, seating, accreditation or logistics. Where another member of The Independents Group, a client, venue, front-of-house provider, event partner or other third party is separately responsible for collecting or processing your personal data, their own privacy notice may also apply. We may also collect personal data you provide voluntarily via sign-ups available at an Event, whether via a QR Code or otherwise, including: Contact Information: name, email, phone number (if provided). Device and Usage Data: IP address, device type, operating system, QR Code scan timestamp. Optional Information: any additional data you provide during sign-up. We do not intentionally collect special category data, sensitive personal data or sensitive personal information unless it is necessary for the Event or you choose to provide it, for example dietary requirements, accessibility requirements, health and safety information, identification details or security/access information. Where applicable law requires consent or separate consent for this processing, we will obtain it. Where children or minors attend or participate in an Event, shoot, production or campaign, we will process their personal data only where necessary and with appropriate safeguards. Where required, we will obtain consent from a parent, guardian, agent or authorised representative and will limit collection to what is necessary for attendance, safeguarding, production, travel, payment, compliance or contractual purposes. 2. PURPOSE AND LEGAL BASIS FOR PROCESSING The majority of our personal data processing activities are ancillary to the services we provide to our clients in relation to the production and creation of their Events. In most circumstances, we do not actively collect or process personal data. Where personal data is processed, and in the absence of any specific consent, such processing is carried out on the basis of contractual necessity and/or our legitimate interests, in compliance with the GDPR. Where we operate Event registration, sign-ups, QR codes or similar forms, we will identify the purposes of collection at the point of collection. We rely on different lawful bases depending on the purpose. We generally rely on legitimate interests, contractual necessity and/or legal obligations for Event registration, attendance management, operational communications, access control, security, logistics, reporting and client service delivery. We rely on consent, explicit consent or separate consent where required by applicable law, including for optional marketing communications, certain cookies or tracking technologies, certain sharing with clients for their own marketing purposes, and processing of sensitive information where consent is required. Where you sign up for an Event, submit information via a QR Code or registration form, or opt in to receive marketing communications, we may process your personal data on the basis of your consent where consent is required by applicable law. MARKETING COMMUNICATIONS Marketing communications are optional. Where required by applicable law, we will only send marketing communications, or share your details with a client for their own marketing purposes, if you have opted in or otherwise consented. Where your details may be shared with a client for their own marketing purposes, we will identify the relevant client at or before the point of collection where required by applicable law. Where necessary for the relevant Event, we may share limited personal data with clients, venues, event partners, front-of-house providers, security providers, logistics providers, photographers, videographers, production teams, mailing companies, travel providers and other suppliers involved in operating, documenting or administering the Event. We may also share personal data with third-party service providers and platforms providing IT, hosting, CRM, database, email marketing, analytics, registration, ticketing, event administration and related services, including platforms such as Launchmetrics or Mailchimp where applicable. We may disclose personal data to professional advisers, regulators, public authorities or other persons where required or permitted by law. Where we disclose personal data to third parties, we take appropriate steps designed to ensure that such persons respect the security of your personal data and process it in accordance with applicable data protection laws. We do not share full VIP, talent, influencer or guest databases with clients or third parties as a matter of course. Where we share names, guest list details, contact details, dietary/accessibility information, travel details, images or other Event information, we do so only where necessary for the relevant Event, campaign, booking, logistics, reporting or client service purpose and on a need-to-know basis. 5. INTERNATIONAL TRANSFERS Because we operate as part of an international group, your personal data may be accessed by or transferred to The Qode Group, The Independents Group, clients, event partners, venues, service providers and other relevant third parties in jurisdictions outside your country of residence, including the UK, EEA, United States, Hong Kong, Singapore, Korea, PRC / Mainland China and other countries in which we or our service providers operate. Where we transfer personal data internationally, we take steps designed to ensure appropriate protection in accordance with applicable law. In general: Event registration, guest list and attendance information is retained for the duration of the relevant Event and for a reasonable period afterwards for Event administration, reporting, audit, legal and relationship management purposes. Event sign-up and follow-up data is typically retained for up to 2 years after the relevant Event, unless you continue to engage with us, consent to further communications, or a longer period is required or permitted by law. Images and recordings are retained for as long as reasonably necessary for Event documentation, publicity, reporting, archive, marketing and legitimate business purposes, unless you object and we are required or able to comply. Marketing contact data is retained until you unsubscribe, opt out or object, after which we may retain limited suppression details to ensure we respect your preferences. Usage, device and QR Code data is retained for as long as necessary for analytics, security, reporting and Event administration purposes, and is then deleted or anonymised. Records required for legal, tax, accounting, audit, insurance, regulatory or dispute purposes may be retained for longer where required or permitted by law. When personal data is no longer required, we will delete it, anonymise it or securely archive it in accordance with our policies and applicable law. PRIVACY NOTICE – MAINLAND CHINA PRIVACY SCHEDULE This China Privacy Schedule supplements our General Privacy Notice and applies where the Personal Information Protection Law of the People’s Republic of China, together with applicable PRC data protection, cybersecurity and data security laws, applies to our processing of personal information. SHARING, ENTRUSTED PROCESSING AND DISCLOSURE We may share or entrust processing of your personal information with the categories of recipients described in our General Privacy Notice, including: Agency Group and The Independents Group companies; IT, hosting, CRM, email, marketing and system administration providers; event partners and business partners; professional advisers, including lawyers, auditors, insurers and accountants; compliance screening providers; regulators, courts, public authorities and law enforcement bodies; and parties involved in corporate transactions, reorganisations or integrations. Where required by PRC law, we will provide additional details and/or obtain separate consent before sharing your personal information with another independent personal information processor. 6. CROSS-BORDER TRANSFERS OF PERSONAL INFORMATION Because we are part of an international group, your personal information may be transferred outside Mainland China to Agency Group entities, The Independents Group entities, clients, business partners and service providers in other jurisdictions, including the UK, EEA, United States, Hong Kong, Singapore, Japan, Korea, Switzerland, UAE and other countries in which we, our group companies, clients or service providers operate. Where required by PRC law, we will implement an appropriate cross-border transfer mechanism, which may include: obtaining your separate consent; conducting a personal information protection impact assessment; entering into the PRC standard contract for cross-border transfer of personal information; completing a security assessment where required; and/or applying other lawful transfer mechanisms recognised under PRC law. Where required by PRC law, we will provide additional details of overseas recipients, including their name or category, contact details, country or region, processing purposes, processing methods, categories of personal information, retention period and how you may exercise your rights. RETENTION We retain personal information only for the period necessary for the purposes described in this Privacy Schedule and our General Privacy Notice, unless a longer retention period is required or permitted by law. When personal information is no longer required, we will delete it, anonymise it or otherwise handle it in accordance with applicable PRC law and our retention policies. 8. AUTOMATED DECISION-MAKING We do not use your personal information to make decisions based solely on automated processing that produce legal or similarly significant effects on you, unless we notify you separately and do so in accordance with applicable law. Where we use automated tools, analytics or profiling in connection with our services, we will do so in accordance with applicable law. Privacy Notice for Industry VIPs WHO WE ARE The Qode is made up of different legal entities which trade as “The Qode”, all of which are subsidiary undertakings of The Independents Holding Limited in the UK – CRN: 10186775 (together, the “The Qode Group”). The Launchmetrics Database enables our teams to identify, record and manage contact, professional and industry details and other personal data of Industry VIPs, such as passport details for bookings, shoe/dress sizes, dietary requirements and dates of birth, in each case where relevant for our business and the Services. In this Privacy Notice, the terms “you” or “your” will apply to the extent The Qode collects and stores your personal data as an Industry VIP in connection with the Launchmetrics Database. The Qode respects your privacy and is committed to protecting your personal data. This Privacy Notice will inform you (i) how we protect your personal data when it is used on the Launchmetrics Database, (ii) of your privacy rights and (iii) how the Data Protection Laws protect you. Personal data is any information about an individual which makes them identifiable. It does not include anonymous data – being where the identity is removed. We collate, store and use different kinds of data available to us about Industry VIPs. The majority of such data is provided directly by such Industry VIP. We may also collect certain personal data from third parties, such as clients, event partners, public sources, professional directories, social media profiles or press sources, although we would never purchase such data. For Industry VIPs, such personal data may include: your name, age, email address and company/brand; your account name, social media handles and any other online identifiers; shoe/dress sizes; dietary requirements; your passport details for organising bookings; dates of birth; and any other information which may be relevant to our Services, including information you provide to us in connection with gifting, invitations or event arrangements, such as limited details relating to family members or guests. Some information we process may be special category data, sensitive personal data or sensitive personal information under applicable law. This may include dietary or allergy information where it reveals health, religious or philosophical information, accessibility requirements, health and safety information, passport or identity details, information relating to minors, or other information required for travel, accommodation, event access, security, production, gifting, sample loans, fittings or bookings. We process this information only where necessary, proportionate and permitted by law. Where required, we rely on explicit consent, separate consent, substantial public interest, health and safety obligations, contractual necessity, legal obligations or another applicable lawful condition. We do not use such information for unrelated marketing, profiling or discriminatory purposes. Where we obtain personal data from public sources, clients, event partners, agents, representatives, professional directories, social media profiles or press sources, we provide privacy information directly where reasonably practicable. Where direct notification would involve disproportionate effort, for example because of the size and nature of the database and the limited professional context of the data, we rely on public privacy notices and appropriate safeguards, and we document that assessment internally. HOW IS YOUR PERSONAL DATA USED? We only use your personal data to the extent permitted by applicable law. Depending on the relevant activity, we may process your personal data on the basis of our legitimate interests, your consent, performance of a contract, compliance with legal obligations or other lawful grounds available under applicable local law. Further, the Launchmetrics Database may also benefit Industry VIPs by facilitating connections and collaborations with brands to enable such brands to expand the presence of such Industry VIPs in the wider marketing environment. This in turn allows Industry VIPs to enhance their brand, specialisms and expertise. The Launchmetrics Database therefore provides a mutual benefit to both brands and Industry VIPs by empowering each to build important and strategic relationships for their shared benefit. We process your personal data to enable The Qode to provide Services to its clients. Such Services include arranging guest lists for events, designing social media campaigns and Industry VIP collaborations and, in respect of client products, sample loans and gifting. As above, we also use your personal data to enable us to connect you with clients and brands. POTENTIAL DISCLOSURES OF YOUR PERSONAL DATA We do not routinely share full Industry VIP profiles with clients. However, where relevant to a defined campaign, event, collaboration, booking, gifting, sample loan or other Service, we may share limited personal data with clients, brands, event partners, logistics providers, travel providers, venues or mailing companies where necessary for that purpose. In such situations, we take steps designed to ensure that recipients handle your personal data securely and in accordance with applicable Data Protection Laws. Otherwise, we may share your personal data with third party service providers and platforms providing us with IT, hosting, CRM, database, email marketing, event administration, analytics, payment and related services, including Launchmetrics for Industry VIP data. These providers may process personal data in countries outside your country of residence, subject to appropriate safeguards where required by law. Lastly, we may disclose your personal data to our professional advisers or any other persons to whom we are under a legal, professional or contractual duty to disclose. Our Industry VIP, journalist, influencer, talent and guest relationship information may include confidential and proprietary Agency relationship data. We do not provide unrestricted access to our databases to clients or third parties. Where we share information, we limit it to what is necessary for a defined event, campaign, collaboration, booking, gifting, sample loan, production, reporting or client service purpose. Where we disclose personal data to third parties, we take appropriate steps designed to ensure that such persons respect the security of your personal data and process it in accordance with applicable Data Protection Laws. INTERNATIONAL TRANSFER OF PERSONAL DATA Because we operate as part of an international group, your personal data may be accessed by or transferred to The Qode Group, The Independents Group, Launchmetrics and other service providers or business partners in jurisdictions outside your country of residence, including the UK, EEA, United States, Hong Kong, Singapore, Korea, PRC / Mainland China and other countries in which we or our service providers operate. In general: Industry VIP profile and relationship data is retained for as long as you remain relevant to our Services, campaigns, events, industry relationships or client work, unless you object or request deletion and we are required or able to comply. Event, gifting, sample loan, booking and campaign records are retained for the duration of the relevant activity and for a reasonable period afterwards for business administration, legal, audit and dispute purposes. Passport, travel, accommodation, dietary, accessibility or similar event logistics information is retained only for as long as necessary for the relevant booking, event, travel, security, health and safety or legal purpose and is normally deleted after that purpose has been completed, unless a longer period is required by law. Payment, billing and subscription records are retained for as long as required for tax, accounting, legal and audit purposes. When determining the appropriate retention period, we consider the nature and sensitivity of the personal data, the purposes for which it is processed, applicable legal limitation periods, regulatory requirements and our legitimate business needs.
