HOW WE USE YOUR PERSONAL DATA We only use your personal data when the law allows us to and for the following purposes: To manage our business relationship or communicate with you as a client, supplier, business partner or prospective contact; To fulfil requests, respond to inquiries and provide or receive products and services; To administer contracts, projects and accounts, including procurement and supply chain management; To carry out identity, eligibility, or compliance checks where appropriate; To send relevant updates, business communications, service information or market our services (see “Marketing” below); For internal record keeping, analytics and to improve our operations and services; and To comply with our legal and regulatory obligations. DISCLOSURES OF YOUR PERSONAL DATA We may share your personal data with: Other companies in The Qode Group and/or The Independents Group for the purposes described above; External third parties (such as IT providers, business support services, professional advisers, regulatory authorities or those who provide services to us); Third parties as part of a business transfer, merger, reorganisation or asset sale; and/or Only as otherwise permitted or required by law. Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website. Profile Data includes, where applicable, your username and password, your interests, preferences, feedback and survey responses. Usage Data includes information about how you use our website. This Privacy Notice is issued on behalf of The Qode Group, so when we mention “The Qode”, “Company”, “we”, “us” or “our” in this Privacy Notice, we are referring to the relevant company in The Qode Group responsible for processing your data. The Qode is part of the group of agencies comprising The Independents Group (together, “The Independents Group”). SUMMARY The Independents Group and The Qode are committed to protecting your privacy. When you attend or participate in events we produce or provide services towards, we may capture photos or video for event documentation and may collect contact data if you register or sign-up at the event. We use this for event management, compliance, and – where you opt in – future updates and marketing. Your privacy rights are respected and you can withdraw consent at any time. We only collect your personal data for events if necessary for event operation or if you choose to provide it (for example, via QR code sign-up or registration). Guest images may be captured as part of event coverage. Your information is used only for event management, communications, and – in some cases – future updates with your consent. THIS PRIVACY NOTICE This Privacy Notice has been issued to identify and explain the ways in which The Qode and other members of The Independents Group may collect, use, store, share and process your personal data in respect of our production and creation services relating to client events, fashion shows and shoots, film shoots and sets, exhibitions, stores or other location-specific brand communication or marketing events (each, an “Event”). We do not ordinarily collect personal data in connection with our Event production and creation services. However, depending on certain client requirements at specific Events, we may collect your personal data, including in the following ways: Recording or capturing images of the Event, which may include images of guests, hosts, clients and vendors. Guest list information either provided to us by clients or third party vendors engaged for such services, or by us to the extent we are engaged for such services. Personal data collected via sign-ups available at Events, including QR Codes at Events. 1. PERSONAL DATA WE COLLECT We may collect your image when capturing recordings and/or images of the Event. Ordinarily we or clients will provide notices regarding such activities. By choosing to attend or remain at the Event, you may be photographed or recorded as part of the Event documentation. If you are merely attending, not providing data directly, the use of your data is incidental and minimal. If you do not wish to be photographed or recorded, please speak to an Event staff member or contact us in advance, and we will do our best to accommodate such requests. We may be provided with guest or vendor list details, which is ordinarily limited to superficial contact details, and more commonly kept confidential by the front of house contractor. To the extent our Partners are engaged to provide these services, and are therefore required to process your personal data in connection with such invitation and attendance opportunities, please see such Partner’s websites for copies of their applicable Data Notices, in particular relating to industry VIPs. We may also collect personal data you provide voluntarily via sign-ups available at an Event, whether via a QR Code or otherwise, including: Contact Information: name, email, phone number (if provided). Device and Usage Data: IP address, device type, operating system, QR Code scan timestamp. Optional Information: any additional data you provide during sign-up. We do not intentionally collect sensitive personal data, such as racial or ethnic origin, political opinions, religious beliefs, trade union membership, health, sexual orientation, financial data, or biometric/genetic data. 2. PURPOSE AND LEGAL BASIS FOR PROCESSING The majority of our personal data processing activities are ancillary to the services we provide to our clients in relation to the production and creation of their Events. In most circumstances, we do not actively collect or process personal data. Where personal data is processed, and in the absence of any specific consent, such processing is carried out on the basis of contractual necessity and/or our legitimate interests, in compliance with the GDPR. To the extent we are engaged to operate Event sign-ups, by checking any applicable box and/or submitting your information via the sign-up process, including any QR Code, you consent to The Qode and other members of The Independents Group processing your personal data for the following purposes: Event Registration and Operational Communications To register you for the Event Manage attendance, provide updates and follow-ups for the Event Evaluate and analyse the Event’s outcomes, success and market audiences and similar purposes. Marketing and Promotional Communications To send newsletters, event invites, promotional offers and other information about The Qode, other members of The Independents Group and Clients. Your consent, which you may withdraw your consent at any time by clicking the unsubscribe link in emails or contact DPO@the-independents.com . Please note that withdrawing consent may limit your ability to participate in the Event or receive certain operational communications. Where consent is withdrawn or not expressly provided, we may still process the minimum personal data necessary to manage the Event or comply with legal obligations based on our legitimate interests, ensuring your rights and freedoms are respected. We may also process your data where necessary to comply with legal obligations or to perform a contract with you. 3. MARKETING COMMUNICATIONS By signing-up via any QR Code or otherwise, you may opt to receive newsletters, event invites and promotions from The Qode, other members of The Independents Group and the relevant Client. Marketing communications are optional – you can unsubscribe at any time using the link provided in our emails or as set out above. 4. SHARING YOUR DATA We do not typically share your personal data with Clients, except as needed to provide services. We also do not sell or rent your data to any third parties. In limited cases, we may share data with: Third-party Service Providers (eg email or IT platforms like Launchmetrics, Mailchimp) who act on our instructions. Professional Advisers or other parties where legally required. We ensure all recipients of personal data are contractually obliged to protect your privacy and comply with data protection laws. 5. INTERNATIONAL TRANSFERS Your personal data may be transferred outside the EU/EEA to different members of The Qode Group and The Independents Group or service providers. When transfers are made to countries without equivalent data protection standards, we use GDPR-approved mechanisms, such as Standard Contractual Clauses (SCCs) or adequacy decisions, to ensure your data is protected. 6. DATA RETENTION We retain your personal data only as long as necessary for the purposes described: Event registration and follow-up: up to 2 years after the relevant Event. Images/recordings: retained for as long as needed for Event documentation and marketing, or for 2 years unless otherwise requested. Marketing and communications: until you opt out. Usage and device data: up to 1 year unless anonymized. After this period, your data is securely deleted or anonymized. 7. YOUR RIGHTS Depending on your location, you may have rights to: Access your personal data. Correct incomplete or inaccurate data. Request deletion of your data where no legal obligation exists to retain it. Object to processing based on legitimate interests or profiling. Request restriction of processing. Privacy Notice for Industry VIPs WHO ARE WE? This privacy notice is issued on behalf of The Qode Group, so when we mention “The Qode”, “Company”, “we”, “us” or “our” in this privacy notice, we are referring to the relevant company in The Qode Group responsible for processing your data. The Qode is part of the group of agencies comprising The Independents Group (together, “The Independents Group”). This is our Privacy Notice for Industry VIPs. Please read this Privacy Notice to ensure you are aware of how and why we use your personal data and how we comply with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and all other applicable data protection laws (together, “Data Protection Laws”). WHAT WE DO? The Qode provides communication, PR and event services for luxury and lifestyle brands (“Services”). In connection with these Services, we have compiled and maintain an internal database of industry experts, journalists, influencers, VIPs and talents (together, “Industry VIPs”) (the “Database”). The Database enables our teams to find and feed contact, professional and industry details and other personal data of Industry VIPs, such as contact details, shoe/dress sizes, dietary requirements, dates of birth etc. in each case as relevant for the business and the Services. In this Privacy Notice, the terms “you” or “your” will apply to the extent The Qode collects and stores your personal data as an Industry VIP in connection with the Database. The Qode respects your privacy and is committed to protecting your personal data. This Privacy Notice will inform you (i) how we protect your personal data when it is used on the Database, (ii) of your privacy rights and (iii) how the Data Protection Laws protect you. We act as a controller of the personal data which we obtain about you. What data do we process and how is it obtained? Personal data is any information about an individual which makes them identifiable. It does not include anonymous data – being where the identity is removed. We collate, store and use different kinds of data available to us about Industry VIPs. The majority of such data is provided directly by such Industry VIP. We may also collect certain personal data from third parties, such as clients, although we would never purchase such data. Such personal data may include: your name, age, email address and company/brand; your account name, social media handles and any other online identifiers; shoe/dress sizes; dietary requirements; dates of birth; and any other information which may be relevant to our Services, including gifting – eg family members. HOW IS YOUR PERSONAL DATA USED? We only use your personal data to the extent permitted by applicable laws. We do not typically share your personal data with clients. We use your personal data where it is necessary to pursue our legitimate interests which is to provide our Services to our clients and also for your benefit. Your interests and underlying rights do not override such interests. The Database directly benefits Industry VIPs. This is by providing them the opportunity to attend various high profile and elite events and also to receive giftings and sample loans. Further, the Database may also benefit Industry VIPs by facilitating connections and collaborations with brands to enable such brands to expand the presence of such Industry VIPs in the wider marketing environment. This in turn allows Industry VIPs to enhance their brand, specialisms and expertise. The Database therefore provides a mutual benefit to both brands and Industry VIPs by empowering each to build important and strategic relationships for their shared benefit. Your personal data may also be used (i) where you have provided consent to the processing (subject to your withdrawal at any time), (ii) where it is necessary for us to comply with a legal obligation, or (iii) where it is necessary to perform a contract. FOR WHAT PURPOSE WILL YOUR PERSONAL DATA BE USED? We process your personal data to enable The Qode to provide Services to its clients. Such Services include arranging guest lists for events, designing social media campaigns and Industry VIP collaborations and, in respect of client products, sample loans and gifting. As above, we also use your personal data to enable us to connect you with clients and brands. Opting-out or Unsubscribing In certain circumstances you may have the right to request that we stop processing your personal data. To seek to exercise any such right, please contact info@theqode.com . The Qode reserves the right to refuse any such request to the extent permitted by applicable law. Potential disclosures of your personal data We do not typically share your personal data with clients. Very occasionally, time or logistics may dictate that we may share limited contact details with a client or third party mailing company in connection with a defined campaign. In such situations we ensure all such persons are subject to strict confidentiality obligations. Otherwise, we may share your personal data with third party service providers providing us with IT and hosting related services. Lastly, we may disclose your personal data to our professional advisers or any other persons to whom we are under a legal, professional or contractual duty to disclose. Where a disclosure needs to be made to a third party, we will use our reasonable efforts to ensure that such persons respect the security of your personal data and Data Protection Laws. International transfer of personal data Any personal data we collect may be transferred from time to time to throughout the world – to our group personnel or third parties. Further, the Database may be accessed anywhere in the world by authorised employees of The Qode, including countries which may not have equivalent data protection laws. Where we transfer your personal data outside of the EEA to countries which do not ensure adequate protection of personal data, we seek to use specific contracts approved pursuant to Data Protection Law. This requires such parties to protect your personal data to the standards required in the European Economic Area pursuant to the GDPR. To the extent we seek to rely on another basis for safe transfer of your personal data outside of the EEA, we will keep you updated by way of an update to this Privacy Notice. Data security We operate appropriate security measures designed to prevent accidental or unauthorised loss or access to your personal data. Further, we restrict access to your personal data to only those persons who have a business need to know. Persons processing your personal data on our behalf will only process your personal data pursuant to our instructions and are subject to duties of confidentiality. Data retention We only retain your personal data for as long as necessary to fulfil the purposes for which it was obtained. For this we consider the amount, nature and sensitivity of the applicable personal data, as well as the potential risk from unauthorised use or disclosure, the purposes for which we process your personal data, whether those purposes can be achieved by other means and any other applicable legal requirements.
